General Terms and Conditions
1. scope of application
The following terms and conditions apply to all orders placed via our online store. Our online store is aimed exclusively at consumers.
Consumers are consumers in the sense of the Consumer Protection Act (KSchG) and thus natural or legal persons who are not entrepreneurs.
2. contracting party, conclusion of contract, correction possibilities
The contract of sale is concluded with Battle The Beach UG.
The presentation of the products in the online store is not a legally binding offer, but a non-binding online catalog. You can place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained for this purpose in the order process. By clicking the order button, you place a binding order for the goods contained in the shopping cart. The confirmation of receipt of your order will be sent by e-mail immediately after sending the order.
When the contract with us is concluded depends on the method of payment you have chosen:
Cash on delivery, invoice via Klarna, financing via Klarna.
We accept your order by sending a declaration of acceptance in a separate e-mail or by delivering the goods within three days.
Prepayment
We accept your order by sending a declaration of acceptance in a separate e-mail within two days, in which we give you our bank details.
Apple Pay
In the ordering process, you will be redirected to the website of the online provider Apple. There you can enter your payment details and confirm the payment instruction to Apple. After submitting the order in the store, we will request Apple to initiate the payment transaction and thereby accept your offer.
Credit card
By submitting the order, you provide your credit card details and the credit card company performs an authorization check. After your legitimation as a legitimate cardholder, the payment transaction will be initiated automatically and your credit card will be charged when you place the order. At the time of the credit card charge, the contract with us is concluded.
BillPay direct debit
With the submission of the order, you give the online provider BillPay a direct debit mandate. BillPay collects the invoice amount from your bank account. BillPay will inform you about the date of the debit within two days after receipt of your order (so-called prenotification). Thereby the contract with us comes into effect.
PayPal
In the ordering process you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After submitting the order in the store, we request PayPal to initiate the payment transaction and thereby accept your offer.
PayPal Plus
As part of the payment service PayPal Plus, we offer various payment methods as PayPal Services. After placing the order, you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. This concludes the contract with us.
Immediately by Klarna
After placing the order, you will be redirected to the website of the online provider Sofort GmbH, where you confirm the payment instruction. Thereby the contract with us comes into effect.
Giropay
After placing the order you will be redirected to the website of your bank, where you confirm the payment instruction to your bank. Thereby the contract with us comes into effect.
Paydirekt
After placing the order, you will be redirected to the website of the online provider paydirekt, where you confirm the payment instruction to paydirekt. After placing the order, we request paydirekt to initiate the payment transaction and thereby accept your offer.
Google Pay
In the order process, you will be redirected to the website of the online provider Google. There you can enter your payment details and confirm the payment instruction to Google. After placing the order in the store, we request Google to initiate the payment transaction and thereby accept your offer.
Amazon Pay
In the ordering process, you will be redirected to the website of the online provider Amazon even before completing the ordering process in our online store. There you can select the delivery address and payment method stored with Amazon and confirm the payment instruction to Amazon. You will then be redirected back to our online store where you can complete the ordering process. Cash payment at pickup
You pay the invoice amount in cash upon pickup.

We store the contract text and send you the order data and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the Internet.
4. delivery conditions
In addition to the stated product prices, shipping costs may be incurred. You can find out more about any shipping costs in the offers.
In principle, you have the option of collection from Battle The Beach UG, to be found at CrossFit Sturmflut, Erich-Schlesinger-Str. 62, 18059 Rostock, Germany during the specified business hours of CrossFit Sturmflut.
5. payment
In our store, the following payment methods are generally available:
Prepayment
If you choose the payment method prepayment, we will tell you our bank details in a separate e-mail and deliver the goods after receipt of payment.
Cash on delivery
You pay the purchase price directly to the deliverer. There will be an additional charge of 4,00 Euro.
Credit card
With the submission of the order you give your credit card data. After your legitimation as a legitimate cardholder the payment transaction will be carried out automatically and your card will be charged.
BillPay direct debit
After a successful address and credit check during the ordering process, you issue a SEPA direct debit mandate to the online provider BillPay with the submission of the order and we assign our claim to BillPay. BillPay will inform you about the date of the account debit (so-called prenotification). Upon submission of the direct debit mandate, BillPay will request your bank to initiate the payment transaction. The payment transaction will be executed automatically and your account will be debited. The account will be debited before the goods are shipped. PayPal
In the ordering process you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or register first, legitimize with your access data and confirm the payment instruction to us. After submitting the order in the store, we request PayPal to initiate the payment transaction. The payment transaction is carried out automatically by PayPal immediately afterwards. PayPal Plus
Within the framework of the PayPal Plus payment service, we offer you various payment methods as PayPal services. You will be redirected to the website of the online provider PayPal. There you can enter your payment details, confirm the use of your data by PayPal and the payment instruction to PayPal.
If you have chosen the PayPal payment method, in order to pay the invoice amount you must be registered there or register first and legitimize yourself with your access data. If you have chosen the credit card payment method, in order to pay the invoice amount you do not need to be registered with PayPal. The payment transaction will be carried out immediately after confirmation of the payment instruction and after your legitimation as a legitimate cardholder by your credit card company at the request of PayPal and your card will be charged. You will receive further instructions during the order process.
If you have chosen the direct debit payment method, you do not need to be registered with PayPal to pay the invoice amount. With confirmation of the payment instruction you give PayPal a direct debit mandate. You will be informed by PayPal about the date of the account debit (so-called prenotification). By submitting the direct debit mandate immediately after confirmation of the payment instruction, PayPal requests its bank to initiate the payment transaction. If you have chosen the payment method invoice, you do not need to be registered with PayPal to pay the invoice amount. After successful address and credit check and submission of the order, we assign our claim to PayPal. In this case, you can only pay PayPal with debt-discharging effect. After submitting the order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have a bank account activated for online banking, identify yourself accordingly and confirm the payment instruction to us. You will receive further instructions during the order process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.
Apple Pay
In order to pay the invoice amount via Apple Pay, you must use the "Safari" browser, be registered with the service provider Apple, have activated the Apple Pay function, legitimize yourself with your access data and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. You will receive further instructions during the order process.
Google Pay
To pay the invoice amount via Google Pay, you must be registered with the service provider Google, have activated the Google Pay function, legitimize yourself with your access data and confirm the payment instruction. Giropay

Paydirekt
After placing the order, you will be redirected to the website of the online provider paydirekt. In order to pay the invoice amount via paydirekt, you must have an online banking account activated for participation in paydirekt, be registered there or register first, legitimize yourself with your access data and confirm the payment instruction to us.
Immediately after the order, we request paydirekt to initiate the payment transaction. The payment transaction is carried out automatically by paydirekt. You will receive further instructions during the order process.
Amazon Pay
In the ordering process, you will be redirected to the website of the online provider Amazon before completing the ordering process in our online store. In order to complete the order process and pay the invoice amount via Amazon, you must be registered there or register first and legitimize yourself with your access data. There you can select the delivery address and payment method stored at Amazon, confirm the use of your data by Amazon and the payment instruction to us. You will then be redirected back to our online store, where you can complete the ordering process.
Immediately after the goods have been shipped, we will request Amazon to initiate the payment transaction. The payment transaction is carried out automatically by Amazon. You will receive further instructions during the ordering process.
Purchase on account via Klarna
In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer purchase on account as a payment option. Please note that Klarna invoice are only available to consumers and that payment must be made to Klarna in each case. Financing via Klarna
In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer installment purchase as a payment option. Please note that Klarna Installment Purchase is only available to consumers and that payment must be made to Klarna.
With Klarna's financing service, you can pay for your purchase flexibly in monthly installments of at least 1/24 of the total amount (with a minimum of €6.95). Cash payment at pickup
You pay the invoice amount in cash upon pickup.
6. reservation of proprietary rights
The goods remain our property until full payment.
7. transport damages
If goods are delivered with obvious transport damage, please claim such defects as soon as possible to the deliverer and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.
8. Warranty and guarantees
The statutory law on liability for defects shall apply. Information on any applicable additional warranties and their exact conditions can be found with the product and on special information pages in the online store.
9. Liability
For claims based on damages caused by us, our legal representatives or vicarious agents, we are always liable without limitation
- in case of injury to life, body or health
- in case of intentional or grossly negligent breach of duty
- in the case of warranty promises, insofar as agreed, or
- insofar as the scope of application of the Product Liability Act is opened.
In the event of a breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited to the amount of the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.

The European Commission provides a platform for online dispute resolution (OS), which you can find here. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
